Early Neutral Evaluation is a preliminary assessment of the legal merits of a dispute by an independent person who expresses an opinion on the issues put to him by the parties. The opinion is not binding but it provides an independent assessment of the relative position of the parties and of the likely outcome should the case be heard in court. It provides the parties with a strong platform from which to engage in in-depth negotiations, and can assist them in avoiding further unnecessary litigation. It is for the parties to agree the issues, the evidence and material to be put before the evaluator, and, whether, there are to be oral submissions.
